Whatever you call it, the theft of copyrighted material is just about impossible to control in our ever-expanding, ever-increasing digital age. In fact, there is a widely held belief that technology has made copyright impossible to enforce.

Take the entertainment industry, for example:

While all school children are taught the dangers of plagiarism of print materials when they write their first term papers, many of these same kids are some of the greatest offenders who believe that internet file sharing of their favorite music is their due simply for being fans of this or that rock or rap group.

The music industry, of course, has been vigorously fighting back with numerous lawsuits, many of which target these same young people. And, while some progress seems to have been made, the reality is that the problem is so massive, it is all but rendering music artists’ copyrights useless. While it may be possible to bring some control to the internet, with just a bit of internet savvy and searching, you can find and download programs which can be used to “unlock” the various security features built in to all music and video CDs. You will hear lots of garbage and lots of things that are really close, but really close isn't good enough. You have to be in love with it. You have to be willing to fight for it--to stake your career on it.

Once or twice a year, you'll find something exciting enough and, assuming you fought hard enough to get the band signed (we could do an entire column on that process alone), then it's time to start convincing the people in your own company.

Getting the rest of the company excited about an artist is crucial to the success of the project. It doesn't matter if you're convinced you've just signed the next Beatles--if the promotion department doesn't think it's a hit, they aren't going to give it the big push at radio. No radio, no hit record.

Therefore, as a good A&R guy (or girl) you will spend lots of time shmoozing your own co-workers so that those co-workers will in turn go out and shmooze their contacts at radio, retail, and press.

It pays well and the expense account is great, but it's a high turnover gig in a very volatile industry. Every time you sign an artist, you've stuck your neck out and chances are the band you sign is gonna stiff.

Something like 92% of all records released don't make any money. A couple of stiff records and you're looking for another gig.

My point: It's still a business. It takes a good business head to make enough noise for a major label to find you instead of you getting frustrated trying to get to them. Hey, if it was easy, everybody would be a rock star.

A good, honest, knowledgeable music attorney is an invaluable asset to an artist, and an important part of his Pro Team. Music lawyers serve many functions, the least of which is shopping tapes to the record companies. And because nowadays the top attorneys in the business (you know, the ones who charge $450 per hour), will work for a fee of 5% of the artist's gross income--why, anyone can afford them! Hold on a minute--I'm not being sarcastic.

What Are Some Key Points in
a Personal Management Contract?

Most managers will take between 10% and 20% of an artist's gross income - including record royalties, publishing income, and touring and merchandising income. There will sometimes be a "sunset clause" i.e. a declining scale of payments due to the manager over a few years should you decide to fire or part ways with him (or her).

These are negotiable points, and many nuances and technicalities are involved. You should always have an experienced music business attorney (not your uncle Bob, the divorce attorney) review any management contract.

How Record Companies Make Money

Record companies make money by selling recordings. It is a high-risk business. According to the Recording Industry Association of America (RIAA), approximately 90% of the records that are released by major recording labels fail to make a profit.

Independent labels have to be more careful in their choices and in their allocation of expenses because they do not have the resources to cover many failures. However, they can make and promote records for far lower costs than major labels and be profitable with far fewer sales.

The budgets for making and selling recordings are tied to what labels estimate they will sell. Knowing how many recordings might be sold makes it possible to budget recording costs. Most profitable labels have histories of selling and promoting that enable them to estimate gross income.

Recording costs are borne by artists, not record companies. Record companies commonly make loans to artists (all-in advances) for these costs and recoup them from royalties.

With the exception of jazz and classical artists, new major label artists can spend between $100,000 and $500,000 to make a record, but recording budgets of one million dollars and more are not uncommon.
